QUESTION FOR COURT OF APPEAL
SOLICITOR FOUND GUILTY Auckland, Nov 15 The opinion that there were ques-i tions fit to be sent to the Court of Appeal was delivered by Mr Justice Callan after hearing argument on questions of law arising ou* of th° case of Maxwell Stuart Walker, aged 41, former solicitor, who was found guiltv of failing to account for trust moneys from deceased estates. ' A motion tor an order reserving the question- of law for the Court of Ap peal was opposed by the Crown solicil tor. His Honour said he had. avoided forming any definite oninion in ord-r to leave himself free to sit. It was usual for the judge who stated the case to sit if he happened to be a member of the division which heard the case. It was often an advantage that he should sit. If counsel would draft the case it would he considered His Honour suggested that five one lons of law arose, and he listed them for counsel’s consideration in drawing tin the case It was stated that an implication for the release of accused on bail would be entertained.
