CLAIM FOR DAMAGES

(United Press Association) PALMERSTON N., 21st May. Granting a motion brought by the defendant’s counsel, Air Justice Ostler in the Supreme Court 'made an order vacating judgment and ordering a retrial at the next session of the ease in which tile jury last week awarded Airs Edith Matilda Hodgson, of \Yhakaronga, £2500 general and £lO9 6s special damages, the full amount claimed, against the llawkes Bay Farmers’ Aleat Company for serious injuries suffered when she was knocked down by a ear in December last. His Honour saiil the. case was not one where, vindictive damages should He given. The purpose of damages was compensation for injury, and this had been pointed out lo the jury, who ignored it. He considered that the amount of ■general damages was so large, that no jury could reasonably award it. The special damages were not disputed.
