CHARGES AGAINST FARMER

EVIDENCE AT CHRISTCHURCH

CHRISTCHURCH, This Day.

Arising from the death of Percy Reynolds, Philpott when his motor cycle collided with a car on the main North load at Kaiapoi oil 30th January. James McGivcrn, a retired farmer, aged 62 years, appeared at the magistrate’s court charged with negligently driving a car so as to cause the death of Pliilpett A second charge of driving in a manner dangerous to the public was also preferred. Another motorist, Ronald Graham, said McGiVcrn’s car was forty yards behind witness and the driver seemed to make no effort to pass him. Witness heard a bang immediately nfter a motor cycle from the opposite direction passed him, whereupon lie pulled up and found a collision had taken place between the motor cycle and the following motor ear. He went back and found the car on the wrong side of the road facing Christchurch. Tlie motor cycle was off the concrete on the correct side of the road. The rider Philpott wa s a few yards further on lying against a hedge seriously injured. Constable Conway in evidence said the accused at first refused to make a statement. “He said lie knew a man who gpt six months for making a statement.” Later accused made a written statement which had been-read at the inquest.. .

Accused pleaded not guilty and was committed for trial on the first charge.
