RICHARDSON DIVORCE CASE

WIFE GRANTED DECREE NISI (By Telegraph—Press Association) AUCKLAND, 18th August. Failure to comply with an order for restitution oi' conjugal rights was the ground of an application for divorce brought by Mona Mary Richardson against Kenneth Raliiri George Richardson in the Supreme Court this afternoon. The application was not opposed, and after hearing evidence Mr Jusj tice Smith granted a decree nisi, to be I made absolute after three months, i I-fis Honour said lie was rather troubled about the case. He had discretion in regard to the issuing of the dei cree, and be found it difficult to rid liimI self of information he bad gained during other proceedings in the last few days. As was indicated to the jury in the earlier proceedings on Thursday, there might be collusion. “My client was prepared to return on 18th March, 1932. and also when ihe petition for restitution was filed,” counsel said. “I think the proper course would he for me fo direct the registrar to send all the papers to the Solicitor-General, and lie; can intervene if lie thinks fit in the public interest. Tu tin's proceeding only, the evidence justifies the issuing of a decree nisi to be made absolute after three months,” said his Honour, who granted petitioner the interim custody of the children. The question of costs was reserved. “Under section 24 of the act,” continued his Honour, “I will direct the registrar to forward to the SolicitorGeneral all the papers and evidence in the restitution proceedings, in these proceedings, and in the proceedings Richardson v. Richardson and Jenkins,! to enable the Solictor-General to show ) cause why a decree nisi should not be made absolute, if lie so thinks fit.”
