The Magistrate, Mr Woodward, gave judgment in the case of Nathaniel McKay, charged with obtaining £l7 10s by obtaining work under No. 5 schemo by falsely representing that he had no money in the bank. Mr Woodward said there was no authority on the subject, but after communicating With Air Salmon, S.M., regarding a similar case heard by him he was clearly of the opinion that in doing what he did defendant had not obtained money by false pretences. What he had obtained was work, and for the money he had received lie had ’given the equivalent in work. The charge must be dismissed. He would not say that possibly some other charge would not lie against the defendant.
