MORGAN V. WRIGHT

A FRESH PHASE

(United Press Association)

CHRIST CHURCH; This Day j The Morgan vl' Wright case developed a fresh phase to-day when Judge Adams heard an application for an order for removing a- caveat- from the register of the District Lands Registrar. The caveat was lodged by Lilian Kate Nosworthy, wife of the lion. W. Nosworfhy, and Eva Ethel Roberts, wife of C. C. Roberts, formerly of Ashburton but now of Dorset, England. The caveators are the daughters of E. G. Wright, a former member' of Parliament who died many years ago, leaving his estates at Surrey Hills and Windermere, Ashburton County, to members of his famliy.

The Surrey Hills estate was advertised for sale.'in Chvistchurch on 22nd April by order of the Registrar of the Supreme Court at the request of theBank of New Zealand as mortgagee, D. G. Wright having given mortgages over the land to the bank. The caveat against the transfer of titles to' the land' was lodged some days before the sale. Tho caveators claimed that the land offered for sale came under the Privy' Council's judgment, and that it ia now held subject [ct the trusts of E. G. Wright's will, under which they claim an interest in the estate as beneficiaries. The sale was gone on with and several blocks of land were sold. The bank now asked that the caveat preventing the transfer of titles to the purchasers be removed.

Sir John Findlay, with him Mr Wright, appeared for the bank 'as plaintiff in support of the application. Mr Andrews (for Mrs Nosworthy) and Mr Upham (for Mrs Roberts) opposed the application.
