LOSS OF GOODS DURING TRANSIT

AN INTERESTING DECISION (United Press Association.) AUCKLAND, This Day. The responsibility for the loss of furniture and bedding destroyed by fire in a railway truck was disputed in a claim for £54 16s 6d by Edward Abbott, Ltd., against -Gerald Haycock and Erie AlcCoskrie in the Magistrate’s Court. It was stated that the Railway Department refused to pay for the goods and an extra Is 6d per ton had not been paid with freight to render the Department liable. Defendants ordered the goods from plaintiff, to be delivered by rail to customer. Mr McKean, S.M., said he did not think, under the 'circumstances, there was any duty implied ' on plaintiff except to hand the goods to a transport company in the ordinary manner. Plaintiff was awarded the amount claimed with costs.
