CLAIM FOR INSURANCE FAILS

(Bv Electric Telegraph.—Copyright.) (AuiAfaiiau 4 N.Z. Cable Association!)

LONDON, Julv 13

A month was occupied in hearing a case in the King s Bench in which the Banco Barcelona claimed £15,'505. from the Union Marine Insurance Company in respect to a cargo of cloth valued at. C'375.000 sunk in the steamer Cruz in 1920. . .

Plaintiffs assorted that the captain went down with the ship but the. defence called divers to support the charge that the ship was scuttled. They also asserted that the captain was alive and living in retirement.

Mr Justice Greer found that the ship was scuttled with the connivance of the owners and gave a verdict, for the defendants with costs.

It is understood the litigation will cost £40,000.
