In the High Court argument opened in a special case raising the question whet hot* curt a ill provisions in the Navi gallon Act are invalid, the parties to tile ease being the t n ~-n .Steamship Company and Nicholas .Jones, superintendent of the .Mercantile Murine Office, and the Commonwealth Government. This is a special ease cited for the High Court. The High Court decides that the company is not required bv law to comply with the conditions, including payment of fees, imposed by the Navigation Ad. judgment will be entered for the company for the appropriate sum and costs ; hut if the questions are answered in favour of the Government the company will have to pay the costs of the Arbitration Court during the bearing of the consent agreement entered into by the Ship Painters' and Dockers' l’tiion and the Commonwealth •Steamship Owners’ Association and others. The deputy-president- of flip Couit, Sir John Quick, referred to the siiispcnsion of the hearing of the Union's claim for a new award. He said that at some stage before an award was made he would require the Union to show cause why it. should not give security for the performance of an award when made. Regarding tin* consent agreement. he said lie intended inserting a danse which would enable the owners to apply to the Court for the suspension ' or cancellation of the agreement- if any breaches were committed by the Union, its brunches, or members. !
