MAGISTRATE’S COURT.
FRIDAY, NOVEMBER 8, 1919 (Before Mr. J. S. Evan®, S.M.) BY-LAW CASES. For riding a bicycle without a light on the night, of the Ist inst., at 7.15, George Rothwell was convicted' and ordered to pay 7s Court costs. Henry H. King, on a similar charge, did not appear. Constable O'Donnell arid that defendant’s machine was provided with a lamp, but defendant had statc-dJ that it must have been bumped out.
Convicted and fiend Ss; costs 7s. (This case was subsequently .struck out), Ed. ■ William Petherick, charged with allowing a motor,car to stand in Haven 'Road without being provided- with -a proper .light, did not appear, and was convicted and fined 10s; costs 7a. Edward Charles Russell, motor ’bus proprietor, was charged with on the 4th inst., at 7.45 p.m., driving a moto| ’bus in Haven Road without it being provided with a damn Defendant pleaded not guilty, and said a damp was on the ’bus, but it had gon e out. ' The Magistrate pointed out that defendant was charg-edi with not, providing himself with a’lafpp, whereas the offence was in- mot keeping it lighted. The defendant consented to a verbal amendment of the Information charging him with driving without lighted lamps. It wa® pointed, out the light complained of was a tail light, and Senior Sergeant Barrett said he would not press for a heavy penalty. The Magistrate said that in the circumstances ho thought a warning would he sufficient, and- dismissed tho information.
11 The Magistrate intimated that this case was similar to the on P , against King, where he had entered a" conviction. He thought he had wrongly convicted King and he would therefore strike, the case out, EXCESSIVE SPEED. William Gurkert pleaded guilty to a charge of driving a motoft car around the Trafalgar and Hardy street corner at a speed of more than six miles an hour. Senior Sergeant Barrett stated that defendant’s speed was between 20 ahd 30 miles an hour. Convicted and fined £2; costs 7s. ' 9
