(United Press Association.) * WELLINGTON, This Day. An important judgment, concerning proceedings taken undtr the Sale of Liquor Restriction Act, 1917, was delivered by >Mr Justice Stringer in Supreme Court to-day. - Plaintiff was Minnie Redwood ' and defendant Hans Charles 'Lawson, of Tua Marina, liott lkeeper. Tire 'case depended on an originating summons issued to determine whether defendant can claim the benefit of the provisions ot th Act for a reduction, of rent and adjustment of other charges. Defendant was licensee of the Tua Marina Hot; 1 under lease, which was transferred to liini in August, 1913. Tins lease expired five years after. Defendant was.to give iiotice of renewal of lease three months before expiration. In February last- he served out the owner a notice under section- 4 of the Sale of Liquor Restriction ?Act, asking for. a i\ dnction of rent, on the surrender of the lease under,terms of the section of ' the Act which came into force in October 1917, and counsel for the owner submitt d that the points -were, first, that the Act had no application, except to leases' in existence at the Sate of coming into operation of the Act; second, that the option for renewal, having been exercised after the Act came into, force, uefendant was iii the same position as if he had taken a new lease at the time of exercise of his option, and therefore not entitled, to the benefit of the provisions of the Act > - . me Honour n-eld that the renewal being given, thereby created a lease or agreement, and tihat the lease was within the -meaning of the Act; also that defendant was entitled to benefit (by the provisions of the reductions of rent adjustment and other charges.
