Mr Justice Chapman delivered judgment to-day in an appeal by the Police against the Magistrate's decision in dismissing a charge of permitting drunkenness against Christopher Jansen, licensee of the Wellington Hotel. . Jansen was away at the time, and it was held by the Magistrate that he was not responsible for wrongful acts of a barman. In his judgment, His Honor took the opposite view, and held that a publican's authority was delegated to the barman. He upheld the appeal, and remitted the case to the Magistrate.
