'Solemn Force' Of Death Sentence

(Rec. 1.30 p.m.) SYDNEY, This Day. Mr Justice Gwen said in the Central Criminal Qourt that until the law compelled him to do so. he would not go through the “solemn farce” of pronouncing sentence of death which would not be carried out. Instead he ordered that a sentence of death be recorded against Antonio Martini, labourer, 32 and Edward Garland. Labourer. 34.

The men were found guilty of having wounded a detective at Taronga Fark on September 23, and of wounding. with intent to prevent arrest. The distinction between pronouncing the death sentence and ordering it to be recorded, is formal. Sentence must be pronounced in cases of murder and rape, but may be recorded in some other capital charges. On the second charge the men were sentenced to 15 years’ Imprisonment.
