| invidious position of having to establish their innocence and a detective had been engaged on the case for three months. Defending counsel said this in the Whangarei Court this morning in applying for costs when a civil claim was withdrawn following a conference between plaintiff counsel and a witness. The claim was brought by John Earnshaw, farmer of Jordan (Mr E. ) A. Harrison, instructed by Webb and Ross) against Gordon Whiteman, stock I agent, of Whangarei (Mr R. K. Trim- ! mer). ! I Different Complexion On Case. | ! Asking for an adjournment for a j few minutes, Mr Harrison explained i that one of his witnesses had been I absent in Wellington, and had only just returned. This had prevented him from preparing a brief of his evidence. When the case was resumed, Mr Harrison said that the interview had placed a different complexion on the case, and he would have to ask leave to withdraw. Mr Harrison explained cattle deals which had culminated in the action but it was now found that the two cows, the subject of the claim, had not been sold to Earnshaw at all, as his witness had previously thought. , “It is an unfortunate error but it has occurred in all innocence and was due to a misapprehension by this wit-

ness,” said Mr Harrison. “I cannot now proceed with the case.” Subject of Rumour. In asking for costs against Earnshaw, Mr Trimmer said that the case had been the subject of much rumour v/hich had been damaging to Whiteman. Earnshaw had gone to the police and a detective had worked on the case for three months while Whiteman had been placed in an invidious position and had had to travel hundreds of miles in trying to establish his innocence. The man from whom Whiteman had bought the cattle had also been inconvenienced, and much suspicion had fallen on him .and on Whiteman, all being caused by an opinion expressed to Earnshaw. Judgment for Whiteman was given by the magistrate (Mr Ferner) with costs as on a defended action totalling £9 8/-. Kaikohe Miss Lulu Munn left Kaikohe on Saturday for Auckland, where she will shortly be married to Mr Robert Showier, who is leaving with the Second Echelon for overseas service. Mrs W.
