JUDGMENT for the defendant was given by Mr. E. C. Levvey, S.M., in the Christchurch Magistrate’s Court, in an action by the police against Jasper Lovell Nicolls, who was charged with failing to give information sought by the police. The magistrate. in a reserved judgment, dismissing the information, held that, although the Motor Vehicles Act left no doubt as to what must be done on demand by a traffic officer, there was a gap in the wording of the Traffic Regulations, under which Nicolls was charged, and that there was no onus to give information, and so to be subject to a penalty for failing to do so.
