£2037 DAMAGES AWARDED

Damages of £2037 were awarded to Margaret Lawrence Haigh, aged 13 years, by a jury in the Supreme Court yesterday in respect of injuries suffered when a small car in which she was a passenger was struck by a taxi on October 13,1935. Defendant was Ernest Sydney English, the driver of the taxi. The jury found that defendant had been negligent by driving at an excessive speed and failing to keep a proper lookout.

For the defence it was argued that the reason for the accident was that the driver of the small car was travelling toward the setting sun and did not at any time see the taxi. Defendant denied he was affected by liquor. He had one small measure of whisky. At no time in his journey from Rolleston had he travelled at more than 30 miles an hour. The small car appeared to be going to continue along the Riccarton road, but it suddenly turned across in front of him. He applied his brakes, but it was then impossible to avoid an accident.
