CLAIM FAILS
SHIPMENT OF GINGER. NO COSTS ALLOWED. I Special to “Northern Advocate .*'3 Auckland, This Day. Judgment was delivered by Mr Justice Callan in the Supreme Court yesterday in the claim for £340 concerning a shipment of ginger alleged to have been in a bad condition upon delivery. The claim was brought by Astral Products, Ltd., of Auckland, fruit preservers and merchants, who sought to recover damages from W. J. M. Aitken and Co., Ltd., of Wellington. His Honour said he considered the f evidence that had been called by plaintiff relating to the state the ginger was in when the casks were opened was conflicting, vague and unsatisfactory. Further, he could not resist coming to the conclusion that there had been some delay in preserving the ginger after the casks were opened. Judgment would be entered for the defendant company on the claim with costs. On the counter claim, judgment would be given the defendant for nominal damage of 1/. No costs would be allowed.
