Accused, represented by Mr W. Noble, pleaded not guilty. Thomas McEadden said that on the evening of February 6 lie was sitting on a wall in Hobson Street when the accused struck him from behind on the head with something hard, knocking him down. Accused then kicked witness in the left eye, also on the body, breaking two ribs. Some people arrived and the accused ran off. Witness gave him no provocation for the assault.

In answer to Mr Noble, the complainant admitted he had been in prison, but he denied that he had ever assaulted anyone with his crutch. He denied that ho had called the accused any obscene name, or threatened to hit accused with his crutch.

Medical evidence was given that, when admitted to the hospital, .McFad-. don had two fractured ribs, a .wound on the right side of the skull and. sever > bruises around .the left eye.
