NORTHUMBERLAND CARGO. LIABILITY TEST CASE. (Received 10.45 a.m.) LONDON, July 9. Mr Justice Brai'son, in the King's Bench Division, is' taking evidence in an important test action upon which other claims depend relating to brown heart, in apples. Bradley and Sons, Limited, of "Covent Garden, are claiming £4314 from the Federal Steam Navigation Company, owners of the Northumberland, owing to the development of brown heart in apples shipped on the Northumberland from Hobart in April, 1921. The main issue'of the ease is plaintiffs' allegation that the brown heart was due tobad ventilation in the Northumberland's h01d,.-while the defence is that the brown heart was due to inherent defects in the apples when shipped. Defendants alternatively pleaded that the apple cases were insufficiently ventilated. They are also relying on exceptions set out in bills of lading relating to perils of the sea, giving owners immunity from responsibility in the event of reasonable means having been taken to provide against a ship's defects- and unseaworthiness. —A. and N.Z.
