Intoxicated Motorist Sent to Prison
LICENSE CANCELLED FOR TWO YEARS “I am afraid he will not have the opportunity of paying a fine. He will be sentenced to 14 days’ imprisonment and his license cancelled. Another license shall not be issued within two yearsy” said Mr. J. L. Stout, S.M., in the Magistrate’s Court at Palmerston North yesterday when counsel was asking that a man charged with driving while intoxicated be allowed time In which to pay a fine. Irvin Kirkpatrick Simpson, a contractor, of Paraparaumu, was charged that on October 31, on the FoxtonHimatangi highway, he was intoxicated in charge of & car. He was represented by Mr. A. M. Ongley and pleaded guilty. Senior-Sergeant Mclntyre explained that on Sunday afternoon Constable Owen, of Foxton, stopped Simpson who was then driving past the racecourse. He was taken to the police station in Foxton where a doctor certified that ho was not fit to> be in charge of a car. Simpson, it was explained, had been fined for intoxication while in charge of a car on a previous occasion, at Marton in July, 1934. The case was a particularly unfortunate one, said Mr. Ongley.. Having gone to the races on Saturday, Simpson decided not to drive home that night as he had had some liquor, and stopped in Bulls for the night. Unfortunataly, before he left he met friends who persuaded him. to have two drinks, and hence his condition. He was not actually drunk. The case was a borderline one. There was no suggestion that he was not on his correct side, while he stopped when hailed by the constable. He was a contractor with a mother and daughter dependent upon him, and if a fine was imposed, Mr. Ongley asked that a week be allowed in which to pay it. It was then that the Magistrate sentenced Simpson as stated.
