Judgment for the defendant was given by Mr J. L. Stout, S.M., in the Magistrate’s Court at Palmerston North yesterday in the case in which J. B. Gerrand and Sons, Ltd., jewellers, claimed £59 from Scott Bros, dentists. The claim was based on the fact that stock in Gerrands’ premises in the Square was damaged by water coming through the ceiling from Scott Bros’ surgery on the floor above. When the case was first heard, decision was reserved on a non-suit issue raised by defendants, and then allowed to proceed. Delivering reserved judgment yesterday, the Magistrate said he did not think negligence on the part of Scott Bros had been proved. They had taken all possible precautions, and as negligence had not been proved, judgment would be for defendants, with costs £3 3s. At the hearing Mr L. Laurcnson appeared for plaintiffs and Mr A. M. Angley for defendants.
