Miscellaneous Charges Heard by Magistrate

CASES DEALT WITH YESTERDAY Mr. J. L. Stout, S.M., dealt with a list of miscellaneous charges in the Magistrate’s Court at Palmerston North yesterday morning. Reporting an Accident. When laced with failing to report an accident to the police, Bernard Scott Kyle (Mr. Laurenson). pleaded not* guilty. Senior-Sergeant Moriarty pointed out that at 9.15 p.m. on Soptember 21 last defendant had been driving on the west side of the Square in tho direction of the railway crossing when ho had collided with a youth on a cycle. Subsequently the boy had reported the incident to the police and had declared that defendant had not asked him whether he had boen hurt.

Tho eyenst concerned, an Ashhurst labourer, told of being knocked off his machine by defendant's ear. Witness said -at his left hand had been cut, while the rear wheel of his machine had been smashed.

Counsel submitted that the charge should be dismissed as defendant had believed the cyclist to bo uninjured and, in any case, the cut hand sustained had not been serious. Mr. totout: That is no excuse for not reporting au accident. Tho injury may not be of a serious nature but- a person struck might be suffering or suffer later from shock.

Defendant was ordercu to pay tlio Court costs of the action 13s and 5s 7d expenses. Various Traffic Breaches.

Failing to give way to traffic approaching on his right resulted ia a motorist, Edward Fisher, being obliged to pay £2 and 16s costs; The police stated that on October 1 last at 11 a.m. a collision , had occurred at tno intersection of College street and Fitzhcrbert avenue as the result of defendant failing to let a motor van pass. Two charges—-having insufficient headlights on his car and having no rear light—were preferred against Cecil Stanley Hall, of Wanganui, who was fined £1 and IDs, and 10s and 10s costs respectively. No driver’s license found Arthur William Lindsay, a truck driver, pleading guilty and called upon to pay 10s and 10s costs. For the same offence Bernard Charles Mitchell was fined 10s and 12s cor-.s. A fino of £1 and 10s costs was imposed ou Harold Stutchbury for having no rear light on his van. Herding stock on a public road, controlled by the Ivairanga County Council, resulted in Reginald de Jersey Vautier being ordered to pay 10s. Costs -were 12s.

Raymond Lawson pleaded not guilty to cycling at night -without a light. Constable Goodwin, however, told how defendant and another person had been found riding in Rangitikei street. Lawson had pulled a torch out of Ms pocket when approached.

“You had better buy a proper light,” said Mr. Stout in fining defendant 10s and costs 10s.

Maurice Orr, Tawhi Poneke (Shannon) and Rod Sinclair were each fined 10s and 10s costs for cycling after dark without a light, while Ethel Wood (Shannon) was obliged to pay tUo same amounts for a similar offence and an extra ss, with 10s costs, for cycling on tho main highway without the regulation rear reflector.

An Unregistered Dog.

Arising out of a complaint received by the police that a person had been bitten by an Alsatiau dog, Ronald Sydney Earl Mudgway was charged with keeping an unregistered dog. He was fined 10s and 12s costs.

Senior-Sergeant Moriarty said that the dog had been in defendant’s yard at the time of the incident and it had apparently been a stray that had been kept. It had subsequently been destroyed.

Licensing Breaches. The licensee of tho Central Hotel, Annie Clarke (Mr. Ongley), was lined £2 and 3s costs for selling intoxicating liquor after hours. The barman at the same hotel, John McDevitt (Mr. Ongley), was obliged to pay £5 and costs 3s for supplying the liquor. Two men found on the premises after hours were fined £2 a.**i £1 respectively with 3s costs each.

A ijne of £2, with 3s costs, was imposed on Alexander Miller who pleaded guilty to being found after tuurs on the Masonic Hotel premises on October 20 last.
