Fire Damage Following Earthquake
WAIROA MEAT CO. SUCCEEDS IN INSURANCE ACTION. CHIMNEY-STACK EXCEPTED Per Press Association. GISBORNE, Aug. 11. Judgment was delivered by Mr Justice Blair, in the Supreme Court to-day, in the action of the Wairoa Farmers’ ■Meat Company and the Bank of New Zealand versus the New Zealand Insurance Company and the Eagle, Star and British Dominions Insurance Company —a claim for £77,800 damages in respect of the destruction by fire of the Wairoa freezing works shortly after the earthquake disaster in February. His Honour declared for the plaintiffs on the policy for the whole damage with the exception of the chim-ney-stack. The judgment points out that the method of ascertaining the quantum of lire damage is the subject of a special arrangement, and by the same arrangement the question of costs is reserved, both matters being deferred in the meantime. General leave was reserved for the plaintiffs to apply for further orders necessary to give effect to the judgment. His Honour’s resume of the case covers 51 foolscap sides and closes with the intimation that the delay in the delivery of the judgment was due to the mass of material examined and the necessity of waiting for a stenographic manuscript of the evidence and argument.
