Foster sued Bernard , 'na neighbour, for £4 Cs, trespass . in respect of straying pigs on separ, occasions in August of this year, whi. defendant counter-claimed for tio, 101 plaintiff’s alleged failure to honour an agreement to repair the boundary fence between the two properties, the state of which, it was alleged, was the whole cause of the dispute. After a good deal of evidence had been heard, his Worship said it was one of those simple cases of bad fences making bad neighbours and one which should really have been settled out of Court. Plaintiff was clearly entitled to his claim for £4 Os, but there was also a good deal in defendant’s coun-ter-claim regarding the agreement for fencing, and was therefore entitled to £4 6s. Each party would have to bear its own costs. Mr. Oram appeared for plaintiff and Mr. Ongley for defendant.
