CASE AGAINST AUSTRALIAN “TRUTH”
APPEAL COURT ORDERS RETRIAL. [By Electric Cable— Copyright.] [Aust. and N.Z. Cable Association, 1 SYDNEY, Nov. 2. On the appeal by the newspaper ‘Truth" against the award to Eden George of £SOOO for alleged libel the Full Court ordered the action to be retried on the issue limited to damages only. The Court thought that, taking all the circumstances into consideration, tho sum awarded was so excessive and so out of proportion to tho circumstances of the case, that is must be assumed tho jury considered the matter from the wrong point of view or under improper understanding of their duty.
