Barr owner of the horse Regent, against the disqualification of the animal under Part XXXII, Rule 4 of the Rules of Racing, consequent upon the disqualification for life of the previous owner, E. E. Lees, by the Auckland District Committee from the first day of Ovctober, 1925, judgment has been delivered as follows: This is a case in which H. Barr states that he took over the horse Regent in settlement of debts owing to him by E. E. Lees, the previous owner. This transaction was dated March 21, 1925. E. E. Lees, the previous owner, was some months after the sale by him to H. Barr of the horse disqualified for life for corrupt practices committed by him on or about March 17 1925. Wo find that on the date of tho sale, H. Barr was aware that the horse Regent might be disqualified under the Rules of Racing by reason of the corrupt practice committed by E. E. Lees. We cannot think, in these circumstances admitted by Barr, that the benefits of Part XXXII, Rule 5 of the Rules of Racing can bo applied to this case. We therefore dismiss the appeal:— (Signed), Harold A. Russell, J. R. L, Stanford, John H. Porrett, Judges. Palmerston North, Ist. December, 1925.
