MAGISTRATE’S COURT

MATTERS OF CIVIL DISPUTE. A sitting of the Palmerston North Magistrate’s Court was held yesterday, Mr. J. L. Stout, S..M, presiding, when civil business was dealt with. Judgment for plaintiff by default was entered In each of th e following cases:—"Manawatu Standard,” Ltd. (Mr. Laurenoon) v. W. Hines (Mr. Merton) £4 17/.. costs £1 19/6; I. M. Webb (Mr. Grant) v. H. Morgan, £7 .15/1, costs £1 18/6; A. Kreft (Mr. Oakley) v. H. Whyte £5 3/10, costs £1 10/6; L. Ewing v. Rowland and Orr, £3, costs £1 3/6. Judgment Summons. E. Pearson, motor agent, was or. dered to pay J. Robson, mercer, tho amount of £1 16/6, in default seven days’ imprisonment. Cows Not Wanted, But Kept. Action was taken by Thomas Saunders, farmer, of Glen Oroua, against William Hines, native farmer, of Balnesse, claiming to recover from defend, ant £173 8/6, being the balance allcg. ed purchase money of 20 cows, and interest. Mr. A. M. Ongley appeared for plaintiff and Mr. J. L, C. Merton for defendant. Counsel for plaintiff said that the parties entered into an agreement whereby plaintiff was to soil to de. fendant 20 cows at £lO a head, to be delivered on December 5, 1924. The cows were accordingly delivered, but the money had not been paid. Defendant had retained them since. The defence was that the agreement made tho cows subject to right of rejection, and It was a question of how many cows had to be paid for. After the cows—only 18— were delivered defendant pointed out the ones he did not want. The animals had remained on defendant’s property ever since, because no effort had been made to take them away. After hearing the evidence, Mr. Stout said that defendant could not reject the cows after all this time, and gave judgment for plaintiff for £142 12/6, with costa £ll 17/6.
