A CLAIM FOR DAMAGES. Barry and Co. (Mr Ongley) sought to recover from Adam Burges and Co. (Mr Innis) and P. and Duncan (Mr Cooke) the sum ol ..iJO lis damages for loss of a motor car part and delay in executing repairs, causing loss of business. Barry's car, it was stated, in evidence, had gone wrong, and a crank required repairing, and A. J. Tozer, representing Burges and Co. and P. and D. Duncan, had undertaken that the repairs could be effected by Duncan. He took the crank away, and it was forwarded on by Burges to Christchurch, and later returned to Barry repaired. He claimed that a pinion sent away with the crank had been lost, and that he could not get it replaced. He had cabled to Australia for one, and the delay in getting this pinion had affected his business. He took £l2 a week with the car, and his expenses were £5. The car had been laid up for six months, instead of two weeks as it might have been. For the defence Tozer and other witnesses swore that the pinion had not been taken away from Barry's, and further that the missing article could easily be replaced in New Zealand It was also contended that Burges was in no way responsible. The crank had been forwarded by him, and he, as agent for Duncan, had billed Barry. His Worship said he would take time to read the evidence which had been given in Christchurch, and give judgment later, when he would hear legal argument.
