INTERESTING APPEAL CASE.
Hamilton v. Bank Of New
Zealand.
(Per Picas Association.) Wellington, Last Night. The Appeal Court is now occupied with the case Hamilton v. Bank of New Zealand and another. In 1889 the Bank of New Zealand, to which he was indebted, sold up plaintiff's property at Mangatoro, in Hawke's Bay, through the Kegistrar of the Napier Supreme Court. The Bank alleged that about £68,000 was then due to the Bank, uud secured the property for £5000. The plaintiff alleges that the property was worth a great deal more and the transaction was fraudulent against him. He claimed' to be allowed to redeem. The Chief Justice held, in the lower Court, that the rule in accordance with the public practice so long established, was that if it was to be disturbed it must bo by the Appeal Court, and not hy a single judgo. Hamilton now seeks tho decision of the Appeal Court. Mr W. L. Reos who appears for him was addressing the Court on facts of the case when it rose.
