No. 94. at page 1248. and in pursuance and exercise ol every other Act and authority in that behalf it enabling and with the approval of the Local Government Loans Board given unde.* the hand of the Secretary of that Board addres-cd to the Town C.crk of the Palmerston North City Council dated the 7th dav of October, 1943, HEREBY RESOLVES by way of Special Order: ,1. THAT THE Goiincil Borrow the said sum of £3,600 for the purpose of paying the ' “Palmerston North Fitzherbert Bridge Loan, 1933,” ol £6,000. 2. THAT such loan of £3,600 be called “Fitzherbert Bridge Repayment Loan, 1944. of £3,600.” 3. THAT the currency of the said lean shall he for the period ol 10 years commencing on the Ist day of I'ebriiary. 1944, and maturing on the let day of February,. 1954.' 4. THAT the interest on the said Lean of £3.600 shall be at the rate ol £3 10s per centum per annum payable by equal instalments on the Ist dav of the months of August and February in each year. 6. THAT no amount payable as either interest or sinking fund in respect of many moneys raised pursuant to this Resolution shall be paid out of such moneys. 6. THAT the rate payable for brokerage, underwriting and procura-lees in respect of the raising of the Loan or any part thereof shall not in the aggregate exceed one half per centum of any amount raised. 7. THAT the form of security for the payment of principal and interest on the said Loan of £3,600 shall lie 36 Debentures of £IOO each payable at the Palmerston North Branch of 'The Union Bank of Australia Limited and relative coupons in conformity with tho provisions of “The Local Bodies Leans Act, 1926,” al.-o payable at the Palmerston North Branch of the raid Bank. 8. THAT the Council doth hereby appropriate and pledge a- security for ■ the repayment nf the said Loan and the interest Sinking Fund and other charges (thereon the special rale of l/19th of a penny in the Pound sterling on the rateable value lon the ba.-is of I lie Unimproved Value) of all rateable property in the City of I’almerslr i North made ami levied by Resolution passed on the 13th day nf December, 1943 (previously to the passing of this Besohilion) and such Special Rate shall he an annual recurring rale during the currency of the said loan and he payable yearly on the Ist day of July in each and every year during the currency of tho said Loan. 0. THAT the principal and ini crest shall ho payab’c at the Palmerston North Branch of the Union Bank of Aus--11 alia Limited. 10. THAT, the Common Seal of the Council of Ihe City of Palmerelon North be affixed to each of the said Debentures to he issued in respect of the said loan with relative coupons attached in the form submitted by the Town Clerk at this (Meeting and that tho Mayor and Town Clerk he and they are hereby authori-ed to sign and countersign respectively such Debentures and Coupons. 11. THAT the signatures of the Mayor and Town Clerk to the coupons attached to the said Debentures arc hereby authorised to he lithographed, 12. THAT copies of this Resolution and of all- other orders, Resolutions and documents relating to the lean certified by the Mayor and Town Clerk as correct extracts from the Minutes of Proceedings of the Council may from lime lo time he sealed with the Common .Seal of the Council as evidence cl the same and issued. 13. THA I’ a Sinking Fund of an anritial sum of £306 he and the same is hereby established in connection with the said Ixiari and the said annual sum of £306 is hereby permanently appropriated and pedged cut of the Special Rate applicable for that purpose and such annual sum shall be payable as follows: Ihe fiisf payment on the Ist day of February. 1945, and subsequent payments an every subsequent Ist day ot February until the Debentures ior the said Loan shall have been fully paid off. 14. THAT in pursuance of “The Local Bodies Loans Act. 1926," and of a” other powers it • enabling it in that hclmlf the Palmerston .North City Council hereby appoints tho Public Trustee *< he the scle Commissioner of the Sinking Fund no:cinbefore provided and such appointment shall he irrevocable anything in ■ the said Act contained to ihe contrary notwithstanding so long as any moneys shall remain owing on the security of tho Debentures issued for the above-mentioned Loan of £3,600. 15. THAT such Sinking Fund shall lie dealt and managed as required by “The Local Bodies Loan Act, 1926,” and all other Acts or laws for the time being in force applicable thereto and all moneys coming into tlio hands oi the Public Trustee bv virtue of this Sinking Fund shall be dealt with by him in accordance therewith and the Public Trustee shall notwithstanding he may at any time he the holder of the said Debentures shall be entitled to charge and deduct and pay himself thereout for Ids services in arid about the collection and investment thereof such commission, remuneration and other charges ns under “The Public Trust Office Act, 1908,” or any other Ac. for the time being be provided in that, behalf. 16. THAT the Common Seal of the Palmerston North City Council he affixed to all deeds, documents and writings nsee'se v for -among into effect the foregoing Resolution. AND the Said Council FURTHER RESOLVES that a- Special' Mooting of the. said Council be held on the 13th day of January. 1944. at 10.15 a.m. to consider and if thought advisable to pass a resolution continuing the above resolution.
