RESERVED JUDGMENT.
CLAIM FOR REPAYMENT. The reserved judgment of His Honour Mr Justice Smith, in a case heard at the sittings of the Supreme Court in Palmerston North in July, in which the Public Trustee took action against Mrs Amy Dillon, widow, of Pahiatua, claiming repayment of £SOO. has been issued. Defendant counter-claimed for the removal of plaintiff as an executor of her late husband’s estate and also claimed the taking of accounts. In the- course of a lengthy judgment His Honour states that plaintiff’s claim must succeed. The counter-claim was withdrawn at the hearing and judgment has accordingly been given for plaintiff on the counter-claim as well. The £SOO was paid under a deed which was later set aside by the Court. Mr K. Biss appeared for plaintiff and Mr 11. R, Cooper for defendant.
