MAGISTRATE’S COURT.

CLAIM AND COUNTER-CLAIM. In the Magistrate's Court yesterday, before Mr 11. P. Lawry, S.M., James Alexander McLcavey, farmer, ol Whakarongo, (Mr A. M. Ongley) proceeded against C- S. Mudgway, dairyman, of Whakarongo (Mr T. E. Rollling), claiming £43 17s. A counterclaim was made by Mudgway lor £7b \'he claim was outlined as being £9 os for 18J dozen bottles allegedly purchased by defendant on Scptcmbci L 1938 - £4 2s as portion of a Power Board account, £4 10s as the price of a tank allegedly purchased by defendant and £26 as a month’s rent ot a farm of £SO acres at Whakarongo. The total in the counter-claim was itiemised at: £ls, the value of extra liav used in consequence of the loss or the use of certain land ; £3 18s as the cost of fencing material supplied by defendant; £35 for rent of part of a house; and £25 as damages tor disturbance and interference and alleged breach of covenant for possession ot land leased by defendant. The hearing of evidence was continued during' the day and at the conclusion judgment was entered for plantiff for £26 (with costs) and for defendant on the counter-claim for £lO 18s, with costs.
