MAGISTRATE'S COURT.
COMPENSATION CLAIM. In tlie Magistrate's Court, Yesterday, before Mr K. M Watson, S.M.. a claim for compensation arising out of the deatli of a working dog killed by a lorry was heard. Mr A. M. Onglev appeared for the defendants, the Cheltenham Dairv (To.. Ltd., while plaintiff, E. AT. Cowdrey, was represented by Mr T. L. Seddon. The claim .set out that defendants by their servant or agent, named McDonald, on August 5, 1938, negligently. carelessly, and unskilfully drove and managed a motor lorry on the Koilding-llaleombe Road that it collided with, and killed a black and tan working dog valued at £lO. After hearing the evidence, the Magistrate held tnat the driver of the lorry failed to keep a proper lookout and therefore v/as negligent. Plaintiff. under the circumstances, was liable to recover, and judgment was entered accordingly for £lO. with costs and expense’s amounting to £3 3s. Mr Onglev upon making application. was granted leave to appeal, security being fixed at £‘23 3s.
