LICENSING CASES
ALLEGED BREACHES. UNUSUAL CIRCUMSTANCES. Unusual circumstances were revealed in a case heard before Mr J. L. Sout, S.M., in the Magistrate’s Court at Palmerston North, to-day, when George Henry Vernon Simpson, licensee of the Carlton Hotel, was charged with selling liquor after hours, and with exposing liquor for sale after hours on May 22. Lawrence Milton Hook, barman-porter at the hotel, was charged with supplying liquor after hours. Leslie Dalzell, a barman employed at another hotel, was charged with having been found on the licensed premises after hours. Air A. Al. Ongley, who appeared for the three defendants, entered a plea of not guilty on behalf of the licensee and pleas of guilty on behalf of the other two.
Constable O’Bo.vle gave evidence that he visited the hotel at 9.45 p.m. Dalzell, who was there, admitted hav-ing-been supplied with two bottles, of beer, but said lie had riot paid for them, as they were for his brother, Norman Dalzell, who was head barman at the Carlton Hotel, but was off duty at the time. Leslie- Dalzell gave evidence that his brother, who was not dressed to go out, had sent him to the hotel to collect a sucking pig and two bottles of beer. Corroborative evidence of this was given by Lawrence Hook. Evidence was given by the licensee that he returned to the hotel from a social function just before the police entered, and he saw Dalzell standing in a doorway. Witness concluded that Leslie Dalzell, whom he had formerly employed, had come in to speak to the night porter. He did not know until later that two bottles of beer had changed hands. It was not his practice to charge his barmen for beer supplied for the latter’s own use.
The Magistrate said the Court must infer that there had been a sale. The licensee was fined £2, with 10s costs,' on the first charge, the second being dismissed. Hook was fined £3, with 10s costs, and Dalzell £2, with 10s costs.
