CHARGE OF ASSAULT.

SYMES AGAIN REMANDED. A CONDITION WITHDRAWN. A remand until September 12 was granted in the Magistrate’s Court, to-day, by Mr J. L. Stout, S.M., when Manley Symes, a labourer, of Paliiatua, appeared on remand on a charge that, on July 24, at Te Mntai, Palmerston North, he did assault Elsie Elizabeth Symes so as to cause actual bodily harm. Detective Barling asked that accused be remanded to uppear on September 5. His wife, he said, was still in hospital and was improving slowly. Appearing for accused, Mr J. M. Gordon asked that the remand be extended to September 12. Accused’s wife was still in Hospital and one of the persons providing bail bad to come at every appearance to Palmerston North from Foxton, which was inconvenient. There had been a provision, said Mr Gordon, that he, as accused’s counsel, should accompany accused to the Hospital every time accused visited his wife. He had visited his wife four or five times in the last fortnight, and counsel asked that the provision that he himself should aceompanv accused to the Hospital should now be withdrawn. The other nartv had been forbidden to see accuseil's wife both by the wife and by the Hospital authorities. Accused and his wife were on perfectly good terms. There was no chance of any clash aris--111 Detective Barling said he had no objection to dispensing with the provision mentioned. \ remand to September 12 was then granted by the Magistrate, the provision being withdrawn as requested.
