JUDGMENT FOR PLAINTIFF.

DAMAGES CLAIM SUCCEEDS. With the evidence for plaintiff’s case concluded in the Magistrate's Court, before Mr J. L. Stout, S.M., this afternoon, the action in which Maude Aiice Collier, of Palmerston North, claimed £lsl 12s lOd damages from H. Dustin, junr., of Wanganui, finished suddenly following upon an announcement that defendant did not propose to contest liability. Judgment was accordingly given for plaintiff for £lOl os 6d. Evidence was given by J. S. Walker, assessor, of Wellington, that he had visited the scene of the collision, near Awahuri, subsequent to the accident, and taken measurements, with Mr Collier, for a plan which he produced. This concluded the evidence tor plaintiff. Counsel for defendant made the intimation at this stage that after the evidence which had beeg tendered he did not propose to contest the matter of liability. However, defendant denied having made any comment that the insurance companies could fight the matter out. He had considered that he was travelling in the middle of the road. Counsel submitted that plaintiff’s personal claim was greatly exaggerated. The Magistrate said the evidence seemed to point to the fact that defendant was on the wrong side of the road.

Judgment was given in favour of plaintiff for £lOl 5s 6d, with £3 costs, £6 Is for solicitor’s fee and £2 10s for witness’s expenses.
