JUDGMENT DELIVERED. WELLINGTON, Sept. 16. Reserved judgment in the case in which Mrs Alice Merry, widow, of Wellington, alleged that grossly inadequate rents had been obtained by the Public Trustee, • as administrator of her late husband’s estate in respect of three properties situated in Brooklyn, Kilbirnie and Hougliton Bay respectively, was delivered by Mr Justice MacGregor in tlie Supreme Court yesterday. His Honour, in an interim judgment, dismissed an application by the Public Trustee for the remission of a report made on tlie matter back to special referee, stating that answers given by the referee appeared to him to result in a definite finding of neglifgenco on the part of the Public Trustee, such negligence consisting in a lack of prudence or diligence in procuring the best rentals reasonably available in respect of tlie three properties specified. One of the legal points His Honour answered in favour of defendant, and the other be answered in favour of plaintiff.
