RENTAL DISPUTE
CLAIM FOR DAMAGES. Per Press Association. WELLINGTON, Sept. 4. Twelve months ago Mrs Alice Merry, widow of John Bierry, bootmaker, claimed £2999 damages in. the Supreme Court from the Public Trustee, as administrator of her husband’s estate, alleging that grossly inadequate rents had been obtained in respect of three properties. After the case for plaintiff had been opened it was agreed between the parties to make the question of the rental value of the properties the subject of an inquiry before a special referee, Blr E. Page, S.BI. Tho referee’s report came before Blr Justice BlacGregor in the Supreme Court to-day, when counsel for Blrs Bierry moved for its adoption and judgment for £l3ll 13s 9d as damages alleged on the basis of the referee’s report to have been suffered by plaintiff “by reason of defendant’s unskilful and negligent management and control of -the properties.” Tills motion was opposed on behalf of the Public Trustee, who filed a substantive motion, and on this legal argument followed.
