CHARGES FAIL.
ACQUITTALS IN SYDNEY. SYDNEY, Sept. 28. After a lengthy hearing three wellknown citv men, Messrs W. J. Curtis, K.C., H. D. Mclntosh, and E. Coveil, were acquitted on a charge of_ alleged fraud in connection with the Tivoli Theatre.
Defendants were charged, on the information of Mr A. J. Parsons, liquidator in Rickard’s Tivoli Theatres, with having, while directors of the Tivoli Company, misapplied a cheque for £13,570, also with conspiring to deal fraudulently with a theatre property. The Magistrate said that, although single transactions might be suspicious, he did not consider fraud had been made out, therefore there was no case to answer. Further minor charges were also dismissed.
Mr Maughan, K.C., who conducted the prosecution, said the case was a tragic one for him, since a leading fellow barrister and a friend happened to be one of the defendants.
