CLAIM FOR POSSESSION.
APPLICATION FAILS
Received September 16, 9.25 a.m. SYDNEY, Sept. 16. When the Permanent Trustee Company tried to obtain an order for the eviction of the Communist Party of Australia from the party’s headquarters in Sydney it failed. This was tho first case decided in the course of the Federal Government’s campaign against Communists. Tho Permanent Trustee Company, as agent for the owners of the building known as the Communist Hall, was advised by the authorities that if it permitted'the Communist Party to occupy tho hall it would bo committing an offenco under the Crimes Act. Although the Trustee Company advised the Communist Party that it was illegal to hold meetings in the hall, the usual Sunday meetings have been held and the Communist Party continues to occupy tho premises. The' application by the company for possession was dismissed by Mr MacDougal, the Stipendiary Magistrate, who upheld tho submission of the respondents that the applicant had not proved the creation or the determination of a tenancy.
