MISCELLANEOUS CASES.

Mr J. L. Stout, S.M., presided at to-day’s sitting of the Magistrate’s Court.

P. A. L. Sim was fined 10s and 10s costs for cycling at night without a light. . E. J. August was charged with failing to give way to a motor car approaching form the right at the intersection of Ferguson Street and Victoria Avenue. Defendant pleaded not guilty. M. H. McKellar stated that he was driving along Ferguson Street, on his correct side, when at the corner of Victoria Avenue he came into collision with, another car, which was qapsizied. Witness took the driver home os he was rather dazed. The other car was approaching on tho left of witness, and failed to give way. H. F. McKellar gave corroborative evidence. Defendant gave evidence that there had been ample room for him to get across the road if the other vehicle had been on its correct side of the road. He thought ho could get over the road and avoid an accident. There was a hedge there which mad© it difficult to sc© the traffic. Ill© Magistrate said the rulo of the road would have to be obeyed. Defendant was fined £2, with 16s costs. R. Craig, who was represented by Mr Onglev', pleaded not guilty to a charge of' failing to report an accident in which injury to a person was involved.—R. L. Weston gave evidence that on the evening of July 27 at the corner of Rangitikei and , Cuba Streets when ho was riding a bicyclo, he was struck by a car of which defendant was the driver. Defendant took witness to a doctor for attention, defendant being told that witness was shaken and bruised. Witness was away from work for a week and four days.—Defendant stated that after the accident, he (defendant) insisted on taking the rider of tile bicycle to a doctor. The latter stated that the man would not require any treatment.—The Magistrate stated that as defendant had taken the cyclist to the doctor and had accepted his statement that the man was not injured, lie would dismiss the case.
