Holland (Mr Cooper) v. L. Parker, £9 15s lid, costs £1 10s Gd. CLAIM FOR COMMISSION. C. L. Mowlem (Mr Grant) proceeded against R. G. Scott (Mr McGregor) to recover the sum of £26 5s allegedly due as land agent’s commission. Plaintiff gave evidence that in November last Mr Scott signed an authority to sell a property in Bryant Street. An agreement was later entered into at his office for the sale of the place. Subsequently, the intending purchaser came to his office and saul the place was not interesting enough and asked if she could get out of the agreement. Plaintiff said the matter was out of lais hands and referred her to Mr. Scott’s solicitor. Later lie sent a bill to Mr Scott for the commission, hut the account was repudiated and had not been paid. . Defendant deposed that the agreement was signed by the sister of the prospective purchaser and defendant. Afterwards ho learnt that the prospective purchaser had repudiated the agreement. in reply to Mr Grant, defendant said lie later sold the property to somebody else. The Magistrate reserved his decision. CLAIM FOR RENT. An action was heard in which the Public Trustee (Mr Lusk) claimed from William John Barlow (Mr Laurenson) the. sum of £9 as rent in respect of the Manakau Town Hall. Defendant had paid the sum of £3 Gs into Court. Counsel for plaintiff stated that arrangements had been made during the lifetime of Mrs Dalzell for defendant to rent the hall on Wednesday nights to show pictures at 14s per week, this arrangement being continued when the estate, wqs being administered by the Public Trustee. William Dalzell gave evidence that the tenancy was entered into in 1930, the rent at first being 12s per week and afterwards 14s per week. He stated that defendant was to have the Hall every Wednesday and to pay whether he used it or not. Defendant stated in evidence that the first arrangement was that lie should pay 14s per night- for the use of the hall and plant. The plant was later taken out of the hall and defendant desired a reduction in rent. About this time Mrs Dalzell died and j later Ire received a demand from the Public Trustee for the rent. His contention was that he was to pay for the hall only for the nights on which it was used and he had paid into Court the amount due on that basis. Defendant had written to the Public Trust Office in January stating that unless some fresh arrangement was made he would not bo using the hall again. Judgment was given for plaintiff for £2 16s and £2 4s Gd in addition to the amount paid into Court.
