A very fine specimen of a Maori axe was dug up in Fraser Street, Tauranga, a few days ago. It was discovered during excavations by Tauranga Borough Council employees. With an admission of liability by the defendant, the only question the jury had to decide in an action for damages in the Supreme Court was whether the sum claimed, £lll2 4s 6d, was fair and reasonable. The plaintiffs were William McGlashan Smith, waterside worker, of Wellington, and his wife, Charlotte Smith, a bookseller, who was knocked down by a cyclist, Gilbert Jepson, at Island Bay, in November last. The jury awarded £2OO special damages, and £3OO general damages. “It may interest you to know,” Mr Justice Ostler said after the jury had returned its verdict, “that that is exactly the sum I would have awarded had I been deciding the case.” Asthma!
