CONTRACTOR’S CLAIM.

SUPREME COURT ACTION. The Palmerston North Supreme Court was occupied this morning with the resumption of the defendant’s case in the action in which Patrick Carr, contractor, of Dannevirke, proceeded against the Dannevirke County Council for £469 which he alleged was short payment on a quantity of road metal. His Honour the Chief Justice, Sir Michael Myers, presided. Kenneth McCailum, foreman of the County Council, stated that he had carried out an inspection, of the. road in company with the county engineer. Measurements were taken of the holes made in the formation of the road by a previous witness. A Dannevirke contractor William Mayo, who drove plaintiff and Mr Gilmour to the road when the holes were dug in the metal, was called to give evidence of the manner in which the work was carried out. Hie Honour: Were you employed to take these men out? —Yes. His Honour : Who asked you to give evidence in this case? Witness: The county engineer, with whom I am acquainted. . Lengthy evidence concerning the negotiations of the council with plaintiS and particulars of the specifications and contract were given by George Harris, county engineer. He also detailed the visit to the road where, in company with the foreman, he had taken measurements of the holes made in the metal. He was Prepared to rest his representation on the depths as recorded by him.. “I invite Your Honour to come and inspect the holes.” ho added. , “I certainly will not inspect the holes” said His Honour, smdingly. The Court at this stage adjourned for lunch.
