PACIFIC FLIGHT.

THE PARTNERSHIP CLAIM

SYDNEY, July 31. The hearing of the application for an injunction by Mr Iveitb Anderson against Captain Kingsford Smith and Mr C. T. P. Ulm was continued to-day. Mr Anderson claims that ho was a partner in the Pacific flight, and is asking that the Court order that an account be taken of the partnership The hearing was adjourned until Thursday.

Litigation arising from the Pacific flight was begun in the Equity Court on July 21 by Mr Keith Anderson, who claims a share of the profits of the flight from Captain Smith and Mr Ulm and alleges that ho was in partnership with them since July, 1927, when preparations.for the Pacific journey was begun. Plaintiff declared that he went to America with Captain Smith and Mr Ulm. He advanced sums of money t& help along tho venture, and after the purchase of tho aeroplane he, with the consent of the defendants, returned to Australia. Mr Anderson swears that he has advanced more than 2000 dollars to date. Defendants deny tho partnership and contend that the Southern Cross monoplane was the gift of Mr I. Allan Hancock, a retired capitalist of Los Angeles. Mr Justice Owen granted a temporary injunction restraining defendants from dealing with the flight funds.

WARNER PARTS FROM LYON.

LOS ANGELES, July 21. Mr James Warner, the wireless oper. ator, and Captain Harry Lyon, the navigator of the Southern Cross in its flight over the Pacific, have definitely split, states the Los Angeles Times. “There will be absolutely no negotiations between Captain Lyon and myself,” Mr Warner is reported to have said, “and I refuse to be a party to any project which includes him.” The breach really began in Australia, according to Mr Warner, who said that Captain Lyon made friends of whom he (Warner) could not approve.
