In tbo trial of Colonel Mitchell the prosecution granted the defence’s request that 73 witnesses be summoned, and stated that the prosecution would give liberal aid concerning the admission of the testimony when the Court was reconvened on the 9th nist. There is a probability, however, that the prosecution will block any attempt on tho part of the defence to prove the truth of Colonel Mitchell’s charges. The action, in agreeing to the calling of the above-mentioned witnesses followed tho defence’s attempt to end the proceedings by making a motion for a verdict of not guilt*/ on the grounds that the introduction by the prosecution of Colonel Mitchell’s critical speeches (upon which the prosecution rested its case) was insufficient proof of the misconduct charges. Tho prosecution overruled the motion. Mr Reid, counsel, in defending the motion for dismissal, said: “How can any fair-minded, intelligent American citizen, having his country’s welfare at heart, ■’ after reading statements and having in mind tho events lending to their issuance, contend for one moment that they were issued with any other intent whatever than tlie correction of the evils they denounced in plain language; secondly, of the arousing of the conscience of tho American people to stop the extravagance of Government money; and third.lv, preventing the continuance of the loss of life and treasure through incompetence and maladministration of the national defence an service.
