ASSAULT ON A TRANSPORT.
<Psa Press Association.) DUNEDIN. Nov. 5. Mr Bartholomew, S.M., gave judgment in a ease in which a fireman on a transport (James Ferguson) was charged with assaulting the first and fourth engineers of the ship. Legal points, raised by Mr Hanlon in the defence, were that it Avas not proved that the ship was on the high seas, and that the ship, being a transport, was exempt from the Shipping and Seamen's Act.
The Magistrate upheld the latter point holding that the vessel, being engaged in transport work, was under complete control and possession by the Crown, which ]>ossession would be incomplete with subjection to the provisions in tho Shipping and Seamen's Act. The Magistrate amended the charge in respect to the first engineer to one of committing an assault on a British ship on the high seas, and sentenced Ferguson to two months' imprisonment. The charge respecting the fourth engineer was dismissed, the Magistrate stating that it appeared that the officer could could have awoided the fight, but decided to deal with the offender after the methods of Captain Kettle.
