COMPENSATION CLAIM

Tho case of the Kairanga County Council and R, K. Bannister and Smith Bros., the matter of a claim for compensation for tho taking of a piece of laud for a road, was, on tho application of Mr Cnopcr, for the Kairanga County Council, ordered to be heard before the Full Court of Appeal. Mr Moore appeared for R. E. Bannister, and Mr P. E. Baldwin, with him Mr Oram, for Smith Bros. EXECUTORS' ACCOUNTS. An order that executors' accounts be rendered in the case of Edward W. Ruddick and others v. John C. Eccles and Edwin J. Gothard, executors of the estate of the late Mr Ruddick, of Woodville, was asked for by Mr limes, on behalf of plaintiffs. The claim was not defended, and after hearing counsel, his Honor granted the order as asked by plaintiffs. RESERVED JUDGMENTS. His Honor intimated that reserved judgment in the case of J. C. Lane v. F. E. B. Lovelock, a claim for commission, would be given to-morrow morning. McLENNAN v. WOODFIELD. Mr Innes informed his Honor that th* parties in this action had been unable to agree upon tho damages to ho awarded, and his Honor was therefore asked to give judgment. His Honor intimated that he would do so to-morrow morning. The Court then rose. j FALKNER v. FALKNER. 1 Mr Von Haast, of counsel for the plaintiffs, applied for the dismissal of the above action. He intimated that, a memorandum executed by all patties would bo filed in the Court whereby the defendant's right for life to the estate claimed, would be admitted, and amongst oilier things with a right of full power of testamentary disposition, and an undertaking by the plaintiffs to pay the defendant's costs of action. Mr Fitzherbert, of counsel for defendant, Eliza Falkner, agreed, and the case was I dismissed accordingly.
