APPEAL COURT.
(Peb Prkrr ASSOCIATION.) WELLINGTON, May_ 5. The Appeal Court has reserved judgment in the case of Stansell v. Eaeton, a case concerning the sale of a- Foxton hotel property. The Court of Appeal {their Honours Messrs Williams, Chapman, and Sini) this afternoon sat to hear the appeal in re Horowhonua No. XI from the judgment of Sir Robert Stout, refusing a motive for certiorari to remove tho order of the Native Appellate Court, dated 20th September, 1898, into the Supremo Court, in order that the said order of the Native Appellate Court should bo quashed. The ground of motive is that tho order of the Appellate Court was made without jurisdiction.' The Chief Justice, in tho Court below held that the Native Appellate Court could, under tho Horowhenua Block Act, 1896, consider who was beneficially entitled in Block XI, and that to enable them to arrive at that conclusion they had a right to consider how the block has been divided, and what tho original owners acquired in other parts of the block; that this was what tho Native Appellate Court did, and that there was nothing to show that it had exceeded its jurisdiction, Ho therefore dismissed the motive for certiorari.
From this judgment appellants now appealed. Mr P. E. Baldwin appears for appellants, Mr M. Liickio for some of the natives interested in supporting the appeal, the Solicitor-General for the judges of Native Appellate Court, and Mr Mcnteath for the natives interested in the upholding of the order of the Native Appellate Court. Argument had not concluded when the Court adjourned till Monday.
