A PAHIATUA CASE. "In the case at the Magistrate's Court yesterday, in which Frederick Dunn, formerly of Konini, contractor, was charged that being the seller of three draught horses, one dray, three sets of harness, and three horse covers, for the sum of £155, in order to induce the purchaser. Joseph Powell, to accept the title, he did on November '2. 15)03, with intent to defraud, conceal from Powell a bill-of-sale for £100 over the horses and outfit, evidence, in addition to that published yesterday, was given by J. D. Crewe, land agent, Pahiatim. Witness said that in October, 1903, accused came to him in company with Mr Vile, and asked if witness had any money to lend. Witness replied in the affirmative, and wanted to know what security accused had to offer. He replied that he had three draught horses, a dray, some covers and harness. They then went to Smith and McSherry's, solicitors, Pahiatua, and arranged to lend accused fclOO on tho security already mentioned. The bill-of-sale was drawn up and signed by accused in the presence of witness and Mr McSherrv, and registered in the Supreme Court, Wellington. The bill-of-sale was read over to accused before he .■signed it. Witness had searched for the bill-of-salc, but could not find it. He went home to England, in April, 1903. and had not seen it since. A week or so after the bill-of-sale had been issued witness saw the horses in the possession of Thomas Powell. When he saw them in Powell's possession accused's debt had not been paid.. Accused never paid the money, but subsequently Thomas Powell satisfied the bill-of-sale, another having been drawn up and signed by him. It contained exactly the same provisions as the previous bill-of-sale signed tw. accused.

' Accused pleaded not guilty, reserved iiis defence, and was committed for trial at the coming sittings of the Supreme Court, Palmerston. The hail granted was as before: £200 and two sureties of £100 each.
